General Description:
The Commissioner of the Office of the Workmen's Compensation Commission (OWCC) is a senior executive position within the American Samoa Government (ASG) responsible for the overall administration, enforcement, and management of the Workmen's Compensation Act. The Commissioner will ensure that both employees and employers in American Samoa comply with the statutory requirements for workers' compensation, including the processing of claims, educating employers on their responsibilities, and managing the claims system in an efficient and transparent manner. The position requires strong leadership, knowledge of workers' compensation laws, and the ability to implement effective policies and outreach programs to foster compliance.
Key Duties and Responsibilities
Regulatory Oversight and Compliance
Ensure adherence to the American Samoa Workmen's Compensation Act and related regulations.
Monitor and enforce employer compliance with insurance and reporting obligations.
Propose updates to laws and regulations to address the evolving needs of the workforce.
Claims Management
Oversee the processing and investigation of claims to ensure fair and timely resolution.
Provide expert guidance on complex claims, disputes, and appeals processes.
Collaborate with medical professionals, insurers, and legal counsel to address claims issues.
Employer and Public Engagement
Lead initiatives to educate employers on compliance and foster workplace safety.
Develop and deliver training programs to promote awareness of workers’ compensation laws.
Serve as the public spokesperson, providing updates and responding to inquiries.
Policy and Program Development
Collaborate with stakeholders to develop policies that enhance the workers’ compensation system.
Implement programs to prevent workplace injuries and reduce claims frequency.
Leadership and Administration
Supervise OWCC staff, providing training, performance management, and professional development.
Manage the OWCC budget, ensuring efficient resource allocation.
Coordinate interagency collaboration on public safety and workplace health initiatives.
Reporting and Evaluation
Prepare regular reports on claims data, compliance trends, and system performance for the Commission and Governor’s Office.
Evaluate the effectiveness of policies and programs, recommending improvements as needed.
Knowledge, Skills, and Abilities (KSAs)
In-depth knowledge of the American Samoa Workmen's Compensation Act and related regulations.
Expertise in insurance practices, claims management, and occupational safety standards.
Strong understanding of labor laws, workplace health standards, and employee rights.
Exceptional leadership and organizational skills, with the ability to manage teams and budgets effectively.
Proficiency in data analysis, reporting, and using data to guide decision-making.
Advanced problem-solving and conflict resolution abilities, especially for managing disputes.
Excellent communication and advocacy skills for engaging with government officials, businesses, and the public.
Ability to develop and implement policies, interpret complex legal documents and provide actionable guidance.
Strong multitasking capabilities, with a focus on meeting statutory requirements efficiently.
Academic and Experience Requirements
Education:
A bachelor’s degree in law, public administration, business administration, or a related field from an accredited institution.
A master’s degree or specialized certifications in occupational health, workers’ compensation, or insurance management is preferred.
Experience:
A minimum of five (5) years of professional experience in regulatory compliance, claims management, or a related field, with at least three (3) years in a supervisory or managerial role.
Experience working in a government or regulatory environment is highly desirable.
Proven experience in policy development, claims processing, and managing legal or regulatory disputes.
Certifications:
Certifications or specialized training in insurance, claims management, or public administration will be considered a plus.
Salary
The salary is competitive and based on experience and qualifications. Specific compensation details will be provided upon request.
